Amicus Brief calls anti-MAS law unconstitutional

by David Safier

A suit An amicus brief filed by the Vince Rabago Law Office states the law designed to make MAS courses illegal is unconstitutional because it is "impermissibly vague" and therefore "violates both Fourteenth and First Amendment constitutional protections for public school students and teachers." [Note: I revealed my vast legal ignorance by calling this amicus brief a "suit." I regret the error.]

You can read the brief here.

I haven't read the entire brief. It's way above my pay grade. But here at BfA, I'm surrounded by top legal minds, and some of you out there may also have more skills in this area than I do. So a more thorough discussion of the suit brief may be forthcoming.

The brief divides into three sections: The first states the anti-MAS law is unconstitutional. The second states that Mexican American Studies "is an integral part of American education and the field has established global academic importance and respectability." The third states programs like MAS are in everyone's best interest in a multicultural society because they "reduce racial isolation and improve academic performance."
