Ninth Circuit rules for the DREAMers: ‘animus toward DACA recipients … is not a legitimate state interest’

brewer_hateToday the Ninth Circuit Court of Appeals smacked down Governor Jan Brewer for her executive order denying drivers licenses to Deferred Action for Childhood Arrivals (DACA) aka DREAMers because her executive order as motivated out of “animus toward DACA recipients themselves, in part because of the federal government’s policy toward them” . . . “Such animus, however, is not a legitimate state interest.” Read the unanimous opinion of the three judge panel of the Ninth Circuit Here (.pdf).

the Arizona Capitol Times (subscription required) reports, Court clears way for “dreamers” driver’s licenses, says Arizona policy motivated by animosity:

Calling the state policy motivated by animosity, the 9th U.S. Circuit Court of Appeals on Monday ordered that “dreamers” who the federal government allow to work in this country also be issued Arizona driver’s licenses, at least for the time being.

Will the Real John Huppenthal Please Stand Up?

Since Blog for Arizona broke the story, new insights into Arizona Superintendent of Public Instruction John Huppenthal’s secret life as an Internet troll continue to be revealed as bloggers and journalists study years of online comments.

Between Tucson Progressive blog and Blog for Arizona (BfAZ), there are nearly 400 comments from Thucydides or Flacon9, but there could be more unknown Huppenthal posts out there.

An anonymous tipster now claims that someone with the online name “Thucydides” has made comments on at least one white nation (WN) website. Are BfAZ Thucycides and WN Thucydides the same person? No one knows. BfAZ figured out that Thucydides was Huppenthal by analyzing comments, e-mail address, and IP addresses. Three key findings cemented the identification: Thucydides posted from a Department of Education computer, Thucydides commented from a computer in Japan when Huppenthal was there, and one Thucydides comment was signed by Huppenthal. In the case of the alleged WN comments, the NSA probably knows if they exist and has access to the email addresses or the IP addresses for comparison– but we don’t… yet.

Would it be a big surprise to find out the Huppenthal is sympathetic to white nationalist beliefs? Not really. From his anonymous comments, we already have proof he is a racist– something he has been accused of for many years. Let’s look at his history and his policies.

MESA—Mayor Scott Smith, Republican candidate for Arizona Governor, today called on the Obama Administration to immediately end its use of parole hearings to keep illegal border crossers in the United States indefinitely, instead calling on the President and DHS Secretary Jeh Johnson to use the Expedited Removal Hearings process to speed up the removal of the more than 90,000 illegal immigrants who have crossed the American border since October.

“We need to stop putting children’s lives at risk. We need stop betraying the security of our country and we absolutely need to end the mixed message President Obama and Secretary Johnson are sending to border crossers streaming across the Mexican border,” said Smith. “The Expedited Removal Process is legal and humane – and it will put an exclamation point on securing the American border.

“The Obama Administration needs to stop empowering the coyotes, cartels and organized crime syndicates who traffic in human beings. We can’t allow criminals to continue to profit by luring tens of thousands more children and families by giving them false hope.
