Failed ADP Chairman Branscomb Steers AZ Party into Unfair Labor Practices Charges

ADP HQ Staff Union Members announced today that the Union Orgaining unit will be filing charges of unfair labor practices against the Arizona Democratic Party. This is national-scale disaster for the Democratic Party for which Chairman Branscomb is 100% responsible.

After stalled bargaining sessions and numerous actions that show evidence of
union animus, union staff are standing up to protect our rights and integrity in the bargaining
process. Our voluntary recognition agreement states that “The Employer agrees not to make
public (media, emails, social media, campaign statements) the staff unionization until after a
collective bargaining agreement has been reached.” Chairman Branscomb has violated the
terms of our recognition agreement multiple times, doing it again when he publicly
mischaracterized negotiations during a recent ADP town hall. Instead of seizing opportunities
to negotiate in good faith, Chairman Branscomb chooses to misrepresent the negotiation
process for his own political gain.


“We intend to file Unfair Labor Practice charges because Arizona Democratic Party
management has continued to violate the terms of our recognition agreement and engage in
adverse employment actions,“ said ADP HQ Union Staff. “For months now, we have hoped that
management would come to the table ready to negotiate and live by democratic values; instead,
we’ve experienced indications of union animus. Staff and Arizonans deserve better from a party
and chair that are supposed to champion the working class.”


Management’s actions and attempted actions include:
● Retaliation against bargaining unit employees
● Chargeless investigations & disciplinary action
● Unilateral changes on mandatory subjects of bargaining, including proposed demotions
● Delayed and incomplete responses to formal information requests
● Direct Dealing (quid pro quo) related to disciplinary actions and bargaining terms


Under the National Labor Relations Act, unions have the federally protected right to
organize and not fear retaliation in the workplace. We have countered and stopped bad-faith
attempts, stopping management from usurping the union process and violating the NLRA
throughout negotiations. Our intention in filing charges is to restore accountability in this
process, resulting in better negotiations that lead to a strong contract for both parties. In doing
so, we will embody the working-class values of the Arizona Democratic Party.

This is yet another reason why it is imperative that State Committee Members show up tomorrow and vote to remove Chariman Branscomb and democratically end his reign of misrule.
