Hawaii to “Birthers”: leave us alone losers

Posted by AzBlueMeanie:

The State of Hawaii is about to render moot the bill of "Birther" queen Rep. Judy Burges (R-Skull Valley). From the AP:

Hawaii lawmakers are moving closer to passing a measure allowing the
state to ignore repeated requests for President Barack Obama's birth
certificate.

A conference committee unanimously voted Tuesday to advance the bill to final votes in the House and Senate.

The
proposal allows state government agencies not to respond to follow-up
requests for information if they determine that the subsequent request
is duplicative or substantially similar to a previous request.

The
bill is aimed at so-called "birthers," who claim Obama is ineligible to
be president. They say he was actually born outside the United States,
and therefore doesn't meet a constitutional requirement for being
president.

___

The bill is SB2937.

  1. “It would appear that at least 31 Arizona state legislators think that there is a actual controversy.”

Well, that’s like saying the three stooges (31 stooges?) think there’s an actual controversy. Being an AZ legislator (in the majority) does not necessarily equate with possession of intelligence or logical thinking. Writing stupid laws that are knowingly unconstitutional and using sparse taxpayer money to defend them is poor legislating.

  2. I disagree with your reasoning. Nobody has a dispute over the requirement to be president. Some people however believe that a candidate for President should provide proof that he meets the requirement “No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President;”

Cursing at those who disagree with you certainly doesn’t advance the credibility of your position.

As for being moot I would think that would only apply if Barack Obama plans to skip running for re-election. Do you know something the rest of us do not?

It would appear that at least 31 Arizona state legislators think that there is a actual controversy.

  3. Black’s Law Dictionary: “A question is ‘moot’ when it presents no actual controversy or where the issues have ceased to exist.” “A case is ‘moot’ when a determination is sought on a matter which, when rendered, cannot have any practical effect on the existing controversy.”

Or as Secretary of State Ken Bennett, a Republican, said he believes the measure would violate the supremacy clause of the U.S. Constitution by having states set eligibility requirements for candidates for federal office.

“While everyone has an interest in ensuring that only eligible citizens run for president, there are obvious issues with states implementing what could become a patchwork of different tests for a presidential candidate to prove his (or) her citizenship.”

In other words, the Arizona birther bill is unconstitutional and will be struck down; it can have no practical effect on this fake controversy over Obama’s birth certificate – there is no actual controversy.

Hawaii is saying that it has presented Obama’s certificate of live birth – all that it is permitted to do under Hawaii law – and that is all that is required. Now you birthers go the f#@k away. The issue is “moot.”
