CNN reports, House January 6 committee has decided to make criminal referrals, chairman says:
The House select committee investigating the January 6, 2021, attack on the US Capitol has decided to make criminal referrals to the Department of Justice, the panel’s chairman, Rep. Bennie Thompson, told reporters Tuesday.
Thompson, a Mississippi Democrat, said the committee has not narrowed down the universe of individuals who may be referred.
Asked whether Thompson believed any witnesses perjured themselves, he said, “that’s part of the discussion.”
When the panel makes referrals, Thompson said it will be a separate document from the panel’s final report that will be sent to DOJ.
A select committee spokesperson confirmed to CNN that criminal referrals will be “considered as a final part” of the panel’s work.
“The Committee has determined that referrals to outside entities should be considered as a final part of its work. The committee will make decisions about specifics in the days ahead,” the spokesperson said.
A source tells CNN the criminal referrals the January 6 committee will ultimately be making “will be focused on the main organizers and leaders of the attacks.”
A subcommittee of members was tasked with providing options to the full committee about how to present evidence of possible obstruction, possible perjury and possible witness tampering as well as potential criminal referrals to the Department of Justice, according to multiple sources familiar with the committee’s work.
Democratic Reps. Jamie Raskin, Adam Schiff and Zoe Lofgren and GOP Rep. Liz Cheney, the vice chair of the panel, all trained lawyers, comprise this subcommittee.
The decision of whether to issue criminal referrals has loomed large over the committee. Members on the panel have been in wide agreement that former President Donald Trump and some of his closest allies have committed a crime when he pushed a conspiracy to prevent the peaceful transfer of power, as they’ve laid out in their hearings. But they have long been split over what to do about it, including whether to make a criminal referral of Trump to the Justice Department.
[Committee members] who previously said criminal referrals are not necessary to close out the panel’s investigation say the committee lacks prosecutorial powers, and that the Justice Department does not need Congress to investigate crimes as it has its own criminal investigations into the Capitol attack that are ongoing.
Still, the idea of a criminal referral of Trump, even if entirely symbolic in nature, has hung like a shadow over the panel since it was first formed, and many members felt it was a necessary measure in order to complete its work.

This post is confusing. It keeps jumping back and forth between saying that there will be a referral and saying that a referral is possible or being considered. Which is it? And while we are on the subject, what exactly is an entirely symbolic referral? Would it result in a symbolic conviction? This seems like a lot of silly wishful thinking and face saving for a witch hunt that came up with nothing, like the Russian collusion witch hunt.

You must have been a terrible cop because you seem to know nothing about the prosecution system, or separation of powers for that matter. The congressional committees (legislative branch) have no power to indict and prosecute. They can only make a referral to the Department of Justice (executive branch) which has the power to indict and prosecute. Hence the criminal referral is “symbolic” in the sense that the committee’s investigation has found criminal misconduct that Congress believes merits DOJ prosecution. But it will be special prosecutor Jack Smith and Attorney General Merrick Garland who make the final call.
The debate within the committee is that they have laid out a roadmap of evidence of criminality for the DOJ that a criminal referral is unnecessary. But others want to go on the record for the historical record with a formal criminal referral to DOJ.
The Russia investigation did NOT “come up with nothing.” Part 2 of the Mueller report outlines 11 incidences of obstruction of justice for which Mueller testified to Congress that he did not make a charging decision because he could not prosecute a sitting president under two (legally incorrect) DOJ policy memos which say a sitting president cannot be prosecuted. That Merrick Garland has not prosecuted Part 2 of the Mueller Report is a consequence of a superseding event: Trump’s attempted coup d’état on January 6, a violent seditious insurrection that he incited his personal militia of MAGA/QAnon personality cult followers to carry out. Sedition, insurrection and treason are high crimes that demand prosecution under the Constitution, as opposed to stale charges of obstruction of justice.
