Arizona Attorney General Mark Brnovich, the one that tried to take your health insurance away until the United States Supreme Court stopped him yesterday, is trying to make nice with the Trump Zone Cult base after he would not subscribe to their world view about the November 2020 Presidential election.
In trying to get on their good side again, the aspiring 2020 Republican Senate Candidate wrote a letter to Attorney General Merrick Garland, in his best attempt to sound like the child of Wendy Rogers and Mark Finchem, demanding that the Justice Department refrain from investigating the Maricopa County Sham Audit.
The Arizona Attorney General composed this mostly reactionary diatribe after the nation’s number one lawyer commented to the Civil Rights Division that they may look into the procedures and possibly illegal actions of the Cyber Ninja crowd conducting the Arizona audit.
In passages cited by the Arizona Capitol Times, Mr. Brnovich wrote that Attorney General Garland was “displaying “an alarming disdain for state sovereignty.”
Furthermore, Mr. Brnovich wrote:
“My office is not amused by the DOJ’s posturing and will not tolerate any effort to undermine or interfere with our State Senate’s audit to reassure Arizonans of the accuracy of our elections. We stand ready to defend federalism and state sovereignty against any partisan attack or federal overreach… It is important to remember that the states created the federal government, not the other way around…America’s founders intentionally restrained the federal government’s constitutional boundaries to ensure each state could flourish in unique ways. Today, our federal government has largely forgotten the Founders’ intent, but my office has not…”
The Arizona Attorney General was a little milder (and either know-nothing naive and hypocritical,) up until his last sentence, in his closing when he wrote:
“There are no issues more important for states to prioritize than the integrity of our elections. This is the cornerstone of our republic, binding together the peoples’ trust in the whole of government. Today, we see mistrust in our elections from Americans on all sides of the political spectrum. This should not be a partisan issue. States can and should take every opportunity to reassure all citizens that their vote counts.
My office looks for ways to work alongside the federal government to uphold our laws within the constraints of the Tenth Amendment and the election provisions in Articles I and II. As I have demonstrated several times, however, Arizona will not sit back and let the Bielen administration abuse its authority, refuse to uphold laws, or attempt to commandeer our state’s sovereignty.”

The Capitol Times noted that Mr. Brnovich’s correspondence did not acknowledge that the federal government did have a role in securing elections, voting rights, and pertinent records like people’s ballots.

How our own Attorney General ignores the “rule of law” for political power
“We used to have an Arizona Attorney General that believed in the rule of law.
But now, as Mark Brnovich is running for the US Senate against Senator Mark Kelly, he seemingly serves a different master: Trump Cult Land.
After ex-President/Cult Leader Trump criticized Brnovich for recognizing Arizona’s voting was fair, he changed. Now, as his senate campaign begins Brnovich has is doing a Ted Cruz imitation by surrendering his integrity to a Trump-cult fraudulent audit.
Does the Arizona GOP and Mark Brnovich still believe in the rule of law? Do they have any democratic principles left at all?
On Monday, June 14th, Brnovich with a letter using state letterhead attacked United States Attorney General Merrick Garland for defending the importance of election integrity. Brnovich echoed Trump Cult Land’s false information; the fictions they are using to desperately try to overturn a legitimate election.
And to what exactly does Brnovich object? Garland’s denouncing jurisdictions, like Arizona, engaging in fraudulent post-election activities “based on disinformation” and their using “abnormal post-election audit methodologies that may put the integrity of the voting process at risk and undermine public confidence in our democracy.” Only someone in Trump Cult Land could object to Attorney General Garland doing his job.
Even so, Mark Brnovich claims Garland’s statements are “troubling” with “an alarming disdain for state sovereignty.”
We need to ask some big questions…
Is Brnovich okay with disinformation, fraudulent audits, and undermining democracy if it gets him elected to the US Senate?
Does he condone insurrections like on January 6, 2021?
Does “state sovereignty” nod to the “Proud Boys” or other white nationalist groups he is “one of them.”
We all understand Trump Cult Land and the Arizona GOP would have preferred fewer persons of color, women, and young people to have voted for President Biden, the Constitution guarantees they can. Does Mark Brnovich understand the term “state sovereignty” or, for that matter, the Constitution?
As a Constitutional scholar who has written several books on the topic, I can point to
the Constitution’s 15th Amendment and the Voting Rights Act of 1965 that obligates the federal government to assure states do not deny people the right to vote because of their race. The 19th Amendment obligates the federal government to assure states do not deny people the vote based on sex. And the 26 Amendment obligates the federal government to assure states do not deny 18-year-olds the vote.
We could certainly go on …
But maybe I should just send the Arizona Attorney General one of my books on the subject – I’ll make sure to send the one with pictures…”
Mark Brnovich, judging by the contents of his correspondence with Merrick Garland, would seem more comfortable living in the period of the Articles of Confederation or the Southern Confederacy, two of the United State’s historical dead ends.
This would be funny in a pathetic sort of way if Democracy and real lives were not at stake.
Unfortunately for him, this is 2021, and people like their health insurance and want to know their ballots are being protected and their votes taken and counted accurately.
If he is the Republican Nominee for Senate in 2022, Senator Mark Kelly has two ready campaign commercials:
- Mark Brnovich tried to take your health insurance away.
- Mark Brnovich enabled the Big Lie about Election Fraud and humored those who wanted to take your voting rights away.
This should not be a close contest in 2022 as this is the agent for Representative Democracy (Kelly) going against the apostate of Let the people fend for themselves, Know-Nothing Fringe Reactionism (Brnovich.)
In the meantime, it is probably a safe presumption that some of the Justice Departments’ newly hired Civil Rights lawyers may be making a visit to Maricopa County in the near future if they have not already.
