Mayes and Fontes React to Supreme Court Technical Ruling Allowing Trump’s Executive Order on Restricting Mail In Voting

Timing is everything.

That was the theme of the United States Supreme Court Conservative Majority, allowing the Trump Executive Order restricting mail-in voting for millions of Americans, including Trump supporters, saying in a ten-page Shadow Docket ruling that the states, including Arizona, suing to block Trump’s voting suppressing measure that they lacked standing because the Administration and the Postal Service had not implemented their repressive guidelines yet to cause those states harm.

That they hinted in their ruling that the Executive Order, on the merits, would probably prove to be illegal, is small comfort, considering they have created chaos among voters, especially low-informed ones (who mostly are, talk about biting the hand that feeds you, Trump voters,) who are wondering if their right to vote by mail still exists.

According to Arizona Attorney General Kris Mayes and Secretary of State Adrian Fontes, the right to vote by mail still exists in the Grand Canyon State.

In a statement, Attorney General Mayes said:

“Today’s ruling was procedural. The Supreme Court did not decide whether this executive order is legal, it lifted an injunction while the case continues. Make no mistake: this fight is far from over. States run their own elections. Not the Postal Service. Not the President. We will continue to challenge this illegal USPS rule and ensure Arizonans can cast their ballots as they have for decades — and without interference from the federal government.”

Secretary of State Adrian Fontes offered:

“The most important thing for Arizona voters to know today is simple: nothing has changed. You can still vote by mail in Arizona. Our election officials are preparing for the election, and voters should continue making their plans to participate just as they normally would.”

“I’m not going to ask Arizona voters to become experts on competing injunctions, federal regulations or Supreme Court procedure. That’s our job. If something changes that affects how you vote, we’ll tell you what happened, what it means and what you need to do.”

“There is going to be a lot of noise around this issue. Don’t let rumors determine how you participate in our elections. Get your information from trusted sources. And if you vote by mail: receive it, vote it and return it.”

In his press release, the Secretary also included the link for voters to find out what to do for the upcoming election.

Expect the issue to find its way back to the Supreme Court the minute after the Administration and the Postal Service formally implement the Trump Unconstitutional Voter Suppression Executive Order.

Furthermore, Democrats should run on corruption this cycle and include the Supreme Court, where today’s ruling by the Conservative Majority further demonstrates its allegiance to a Republican-Fascist order. In their campaign speeches, Democratic candidates should call out the naked and corrupt power grab by the conservative justices, along with Republican Congressmen, Trump, his cabinet, staff, and family, while also campaigning for ethics reform, accountability for those and their family members who committed criminal acts, including impeachment if warranted, and expansion of the High Court when a Democratic President takes office again.

Voters should also be prepared to turn out in person at voting sites across the state on November 3, 2026, if the Supreme Court turns reality on its head and rules on the merits for Trump.

Remember these are the same justices who gave Trump partial immunity for some of his domestic terrorist enabling acts on January 6, 2021.
