Sanctimonious Mike Pence Subpoenaed By Special Counsel in January 6 Insurrection Investigation (Updated)

Former Vice President Mike Pence did the right thing on one day in his life – as opposed to all the other days of his life – and this sanctimonious prick wants credit for having done what any patriotic American should have done. This does not make him a hero or a saint, or even extraordinary or special. Let’s not forget that Mike Pence really wanted to get to yes in Donald Trump’s Coup Plot, he even participated in some of the Coup Plotting meetings, but in the end he just could not go through with it.

This sanctimonious prick even copped the haughty attitude that the January 6 Committee and ‘Congress has no right to my testimony’ about Jan. 6: Former Vice President Mike Pence said he was closing the door on appearing before the House Jan. 6 committee in a new interview, saying Congress “has no right” to his testimony.

Note: Mike Pence is the critical fact witness to the greatest Crime in American history. Only he knows what was discussed between himself and Donald Trump, and if he was truly a patriotic American, he would have already voluntarily testified to the January 6 Committee and told them everything he knows about the Coup Plot and the Coup Plotters. Instead he has remained silent and has failed to cooperate. He is not entitled to any leniency from the special counsel.

ABC New reports, Mike Pence subpoenaed by special counsel overseeing Trump probes:

Former Vice President Mike Pence has been subpoenaed by the special counsel overseeing probes into former President Donald Trump, according to multiple sources familiar with the matter.

Sources told ABC News that the subpoena from special counsel Jack Smith requests documents and testimony related to the failed attempt by Trump and his allies to overturn the 2020 election, which culminated in the deadly Jan. 6 attack on the U.S. Capitol.

The subpoena follows months of negotiations between federal prosecutors and Pence’s legal team.

Dilatory actions. Let’s just call this what it is: obstruction of justice.

Smith was appointed in November to oversee the investigation into Trump’s potential mishandling of classified documents after leaving the presidency and obstructing the government’s efforts to retrieve them — as well as a separate probe into efforts by Trump and his allies to overturn the results of the 2020 election.

The move will be seen as a major escalation of Smith’s probe into efforts by Trump and his allies to overturn the election, and suggests that Smith’s investigation has entered a more advanced stage.

It’s not immediately clear to what extent the former vice president might seek to invoke claims of executive privilege over the information sought by Smith, which could set up a potentially lengthy and contentious legal battle with no clear modern precedent.

The crime-fraud exception eviscerates any privilege claim. This unquestionably was a high crime. Mike Pence exited the Coup Plot at the last minute, but he did participate in some of the coup plotting meetings, for which he could still be liable as a co-conspirator. He can invoke his Fifth Amendment privilege against self-incrimination, but there is no sound legal basis for assertion of executive privilege for a coup d’état and seditious insurrection.

A spokesperson for Pence did not respond to a request for comment by ABC News. The special counsel’s office declined to comment.

The sanctimonious Mike Pence has written a book in which he selectively discusses his role in the January 6 insurrection, and he has written op-ed opinions about it. Now he can testify to the special counsel before a federal criminal grand jury. He should cut a deal with the special counsel and agree to be the star witness against Donald Trump. It is unlikely that he will do so. Because he is no patriot and he is no hero.

Update: Sarah  Burris reports, Special counsel just called Mike Pence’s bluff: legal analysts on former VP’s subpoena (excerpt):

Speaking to MSNBC’s Ari Melber, former prosecutor Renato Mariotti said that it’s not clear that it’s necessarily an escalation in the investigation, but he explained that Pence wouldn’t be a target in Donald Trump’s document scandal or the Jan. 6 scandal.

“I think what this suggests to me is that Jack Smith is looking at the campaign to pressure Mike Pence to overturn the election in the United States Senate when there is a counting of the electoral votes,” explained Mariotti. “I think, you know, that is the one piece of information that only Mike Pence can talk about. He had phone calls with former President Trump where he was allegedly pressured to essentially stop the counting of the electoral votes and send the matter back to the states, and there were repeated conversations with him. And I have to believe that that is why Jack Smith wants to speak with him.

Former acting solicitor general Neal Katyal estimated that it’s about a six or seven on a seriousness scale of 1 to 10. He added a margin of error of plus or minus two.

“We’ve had presidents who have been subpoenaed before. Thomas Jefferson was subpoenaed very famously in the early 1800s. Richard Nixon was subpoenaed for the tapes and Watergate. Bill Clinton was subpoenaed for his testimony as well. It’s not unprecedented to have a law enforcement investigator take this step, but it’s a big step,” Katyal acknowledged.

He cited the report saying that the DOJ was negotiating with Pence “for months.”

My guess is Pence did what he’s been doing for the last two years, talk out of both sides of his mouth,” slammed Katyal. “You know, send his aides to say some things but not say much himself and Jack Smith called his bluff and said, you know, we need to get to the bottom of this. Thank heavens for Jack Smith. I thought it was unforgivable that the Jan. 6th committee, which did such a great job, but just let Pence skate and just had testimony from his aides. Pence is kind of like the Forrest Gump in this situation. He’s kind of everywhere, yet we’ve not heard from him. So, I’m glad law enforcement is hearing from him finally.”
