The Conservative-heavy Supreme Court argued a Second Amendment case Wednesday that could nationalize open carry laws when homicides are surging.
The case involves a New York law restricting handgun use outside the home to those who can show “proper cause” or an urgent need to carry a gun.
Justices questioned NRA attorney Paul Clement on what exemptions to the right to carry handguns apply.
Justice Amy Coney Barrett asked Clement whether a Times Square ball-dropping celebration might serve as such an exception. Chief Justice John Roberts wondered why New York gives people in rural areas more licenses than people in cities.
“How many muggings take place in the forest?” Roberts asked New York Solicitor General Barbara Underwood, who represented New York.
Collective right to safety
The decision rides on whether Justice Amy Coney Barrett and perhaps Justice Brett Kavanaugh acknowledge the collective right to safety is greater than an individual’s right to carry a deadly weapon.
Roberts will likely vote with the liberals as he has in abortion, DACA, gay and transgender rights cases, Obamacare, and limiting religious attendance during the Pandemic.
The new fundamentalist trio: Thomas, Alito, and Gorsuch, are always an impediment to justice.
Gunning for the liberals, Justice Elana Kagan noted a law dated 1350 guaranteeing the right to bear arms but NOT to carry concealed weapons.
Rights granted by Heller
The court in 2008 in Heller first acknowledged an individual’s right to own guns at home for self-defense, and in 2010 affirmed that right in McDonald v. Chicago.
The Justices are also haggling over what rights Heller granted.

Arizona currently allows open carry and has done so for as long as I can remember. Chicago has extremely strict gun control laws and does not allow open carry or even concealed carry for most people. So who has the higher gun murder rate?
Are you really comparing Arizona to Chicago?
A city that’s been around since the early 1800’s to a state filled with people who pretty much just moved here from New Jersey? Mostly in the last few decades?

Okay, Phony John, Arizona and Chicago are exactly the same in every way except for open carry.
That of course makes no sense, and you don’t show any evidence that open carry does anything other than make fat old white guys with Glocks strapped to their thighs at the Ahwatukee Circle-K look like silly children.
You do this all the time, and it’s why no one takes you seriously, you make a statement, can’t back it up, say something smarmy about BforAZ, declare victory, and run away.
If you can’t show your work then you’re just the intellectual eunuch we all think you are.
My point is that we have had open carry in Arizona for over a decade and people carrying openly aren’t shooting each other all over the state. In fact, somebody might think twice about robbing and shooting somebody if they saw that they had a revolver strapped to their waist.

John, are you saying everyone in Arizona is carrying all the time and that’s stopping crime?
I can go months without seeing anyone open carrying, and even then it’s usually just some old kook, alone, in a safe place.
Or are you saying everyone is concealing a weapon? How does that work in your theory about seeing a gun being a deterrent, if I can’t see the gun?

Are you saying people were shooting each other all over the state before open carry?
I don’t remember that ever happening.
Do you think people all over Chicago are just running around shooting each other?
Or is that mostly gang related stuff, which you know is as much a societal problem as it is a gun issue. Most people in Chicago are just going about their day.
And again, Chicago is not the murder capital of the US, they have high numbers because there are 2.7 million people in the city.
Almost half of our entire state in just one city.

I’m working on losing a few pounds myself, but that’s because I’m more worried about heart disease than getting robbed on any given day.
