Justice Kennedy announces his retirement: this means war

Justice Anthony Kennedy surprisingly announced his retirement at the end of the term for the Supreme Court — he had already hired his judicial clerks for next term — playing into the narrative of right-wingers who have been pressuring him all year to retire in order to put another young ideological conservative on the Court like junior associate justice Neil Gorsuch.

The New York Times reports, Justice Anthony Kennedy to Retire From Supreme Court:

Justice Anthony M. Kennedy announced on Wednesday that he will retire this summer, setting in motion a furious fight over the future of the Supreme Court and giving President Trump the chance to cement a conservative judicial philosophy on the American legal system for generations.

Justice Kennedy delivered a letter of resignation to Mr. Trump Wednesday afternoon, shortly after a half-hour meeting at the White House, where the president called him a jurist with “tremendous vision and tremendous heart.”

“Please permit me by this letter to express my profound gratitude for having had the privilege to seek in each case how best to know, interpret and defend the Constitution and the laws that must always conform to its mandates and promises,” Justice Kennedy wrote to Mr. Trump.

The Washington Post editorial states it concisely, The Trump administration created this awful border policy. It doesn’t need Congress to fix it. As Senator Lindsey Graham said, pick up the damn phone and make the call.

But as the New York Times interview with White House crypto-fascist white nationalist adviser Stephen Miller makes abundantly clear about what is happening, “they want this” (h/t graphic: Rachel Maddow Show). How Anti-Immigration Passion Was Inflamed From the Fringe:

It was Jeff Sessions who ordered prosecutors to take a new “zero tolerance” attitude toward families crossing into the United States, part of his plans to reshape the country’s law enforcement priorities to limit immigration. It is Stephen Miller who has championed the idea inside the White House, selling President Trump on the benefits of a policy that his adversaries have called “evil,” “inhumane” and equivalent to child abuse or the internment of Japanese-Americans during World War II.

Asked if the images of children being taken from their parents would eventually make the president back down, Mr. Miller was adamant.

“There is no straying from that mission,” he said.

In the recent interview, Mr. Miller dismissed as ignorant the hand-wringing of Republicans about the family separation controversy.

“You have one party that’s in favor of open borders, and you have one party that wants to secure the border,” Mr. Miller said. “And all day long the American people are going to side with the party that wants to secure the border. And not by a little bit. Not 55-45. 60-40. 70-30. 80-20. I’m talking 90-10 on that.”

A referendum on democracy itself is on the ballot

Let’s be perfectly clear: if a Democratic president had done what Donald Trump is currently doing in foreign policy, that president would be the subject of an impeachment proceeding right now as we speak. Republicans would have drafted an article of impeachment for treason, without doubt. But as always, IOKIYAR.

David Leonhardt of the New York Times sums it up nicely. Trump Tries to Destroy the West:

President Trump is trying to destroy [the Western] alliance.

Is that how he thinks about it? Who knows. It’s impossible to get inside his head and divine his strategic goals, if he even has long-term goals. But put it this way: If a president of the United States were to sketch out a secret, detailed plan to break up the Atlantic alliance, that plan would bear a striking resemblance to Trump’s behavior.

It would involve outward hostility to the leaders of Canada, Britain, France, Germany and Japan. Specifically, it would involve picking fights over artificial issues — not to win big concessions for the United States, but to create conflict for the sake of it.

A secret plan to break up the West would also have the United States looking for new allies to replace the discarded ones. The most obvious would be Russia, the biggest rival within Europe to Germany, France and Britain. And just as Russia does, a United States intent on wrecking the Atlantic alliance would meddle in the domestic politics of other countries to install new governments that also rejected the old alliance.

Check. Check. Check. Check. Trump is doing every one of these things.

He chose not to attend the full G-7 meeting, in Quebec, this past weekend. While he was there, he picked fights. By now, you’ve probably seen the photograph released by the German government — of Trump sitting down, with eyebrows raised and crossed arms, while Germany’s Angela Merkel and other leaders stand around him, imploring. Shinzo Abe, Japan’s prime minister, wears a look of defeat.

Resist normalizing criminal behavior in the age of Trump

This is not normal and should not be happening. Period. Full stop.

Today the FBI and intelligence agencies will provide a briefing in an ongoing criminal investigation of the Trump campaign’s “collusion” with Russia to Midnight Run Devin Nunes, the House Intelligence Committee chairman who previously had to recuse himself from his own committee’s Russia investigation because he was caught conspiring with the Trump administration to fabricate the conspiracy theories that the Obama administration surveilled Trump Tower and inappropriately unmasked the identities of Trump campaign officials picked up on signal intelligence to undermine the Special Counsel’s investigation; and Trey “Benghazi!” Gowdy, who spent years promoting Benghazi conspiracy theories against Hillary Clinton that amounted to nothing according to the findings of his own committee reports. These are two of the least credible partisan members of Congress.

More importantly, this meeting is going to occur without the presence of their Democratic counterparts. This is entirely improper and unacceptable. Moreover, Trey Gowdy does not possess the necessary security clearance for this classified intelligence briefing (he is not a member of the Gang of Eight).

There is no doubt that this meeting is certain to result in Nunes and/or Gowdy selectively leaking cherry-picked classified intelligence (a crime) to FAUX News aka Trump TV as soon as today to support the new conspiracy theory of “Spygate,” a label that Trump and his propaganda machine have concocted in order to undermine the Special Counsel’s investigation. The Special Counsel should be considering charging them as accessories to Trump’s conspiracy to obstruct justice, which is what this briefing constitutes.

Authoritarian Tea-Publicans call for the prosecution of the political enemies of ‘Dear Leader’ Donald Trump (Updated)

The crypto-fascist Tea-Publican members of the GOP House Freedom Caucus are calling for the criminal prosecution of the political enemies of their “Dear Leader,” Donald Trump. This is what occurs in tin-pot dictatorships and  authoritarian banana republics.

Matthew Yglesias reports, 11 House Republicans call for prosecutions of Clinton, Comey, Lynch, and others The authoritarianism is coming from inside the House:

Eleven House Republicans — Ron DeSantis, Andy Biggs, Dave Brat, Jeff Duncan, Matt Gaetz, Paul Gosar, Andy Harris, Jody Hice, Todd Rokita, Claudia Tenney, and Ted Yoho — have signed a joint letter to Attorney General Jeff Sessions calling for the criminal prosecution of Hillary Clinton and a variety of other Obama administration appointees, career FBI officials, and even Trump appointee Dana Boente, who is currently the FBI’s general counsel.

Arizona Reps. Paul Gosar and Andy Biggs have always been unfit to serve in any political office, and Arizona voters have both a moral and patriotic duty to remove these fringe radical extremists from office. These sorry excuses for a human being are a disgrace and an embarrassment to this state. As The Arizona Republic editorialized earlier this year, Our View: Rep. Paul Gosar is a disgrace to Arizona. Somebody please unseat him. The same goes for Andy Biggs.
