SCOTUS upholds disparate impact evidence under Fair Housing Act claims

The conservative media entertainment complex, quickly followed by the supposedly mainstream media, expressed shock — shock I tell ya! — that President Obama used the “N” word in an interview with Marc Maron. WTF with Marc Maron Podcast – Episode 613 – President Barach Obama:

Racism, we are not cured of, clearly. And it’s not just a matter of it not being polite to say ‘nigger’ in public. That’s not the measure of whether racism still exists or not. It’s not just a matter of overt discrimination. Societies don’t overnight completely erase everything that happened 200 to 300 years prior.”

First of all, the conservative media entertainment complex feigning shock or outrage over the “N” word when it systematically portrays the first African-American president of the United States in a manner that suggests  he is a”nigger” in every conceivable fashion on a daily basis is incredulous. I have no doubt that many of these right-wing talking heads routinely refer to President Obama using this term in their private conversations away from the mic (and some of them even do it on the air).

hudimgSecondly, President Obama simply provided a textbook example of the difference between overt discrimination (disparate treatment), and more subtle covert discrimination (disparate impact) in discrimination law.

It is the difference between a landlord who tells a renter that “We don’t rent to niggers,” and a landlord who is just as racist, but finds subtle ways to make excuses not to rent to African-Americans (or other people of color).

This was the case before the U.S. Supreme Court in Texas Department of Housing and Community Affairs v. The Inclusive Community Project, Inc. In an important decision today, Justice Anthony Kennedy, who has not always been a friend to discrimination claims, nevertheless wrote the majority opinion upholding the use of disparate impact evidence under Fair Housing Act cases.

RNC Resolution for ‘religious freedom’ (to discriminate) laws

In case you were unaware, the Republican National Committee is holding its Spring Meeting in the hub of the “Kochtopus” in Scottsdale, Arizona. Media Advisory: RNC Spring Meeting.

After Governor Doug Ducey, the man hired by Koch Industries to manage their Southwest subsidiary formerly known as the state of Arizona (h/t Charles Piece) welcomes the RNC to Arizona, at the general session this afternoon the RNC is expected to take up resolutions, including this one. Republicans Rally Behind State ‘Religious Freedom’ Laws:

gop-elephant-w-flag-crossThe Republican National Committee is expected to approve a resolution supporting the passage of state-level Religious Freedom Restoration Act (RFRA) legislation. The resolution passed out of committee on Wednesday and will come up for a vote before the 168-member governing body on Friday.

The resolution seems carefully written to recommend that states adopt bills “that mirror the federal RFRA to protect citizens’ rights to lead all aspects of their lives according to their deeply held religious beliefs.” Indiana and Arkansas recently received national scrutiny for advancing legislation under the name of RFRA that were more expansive than the federal language; both states amended the bills to avoid explicit efforts to allow discrimination against LGBT people.

TUSD Unitary Status Plan: Multiple ways to comment (without leaving your house)

Parents, students, teachers, and activists have been abuzz in recent weeks about the new Proposed Desegregation/Unitary Status Plan for Tucson Unified School District (TUSD).

Mexican American Studies (MAS) advocates see the new plan as a potential way to bring back the program that was killed a year ago by the TUSD Governing Board, after it was found by the State of Arizona to be in violation of HB2281 and, therefore, in the opinion of the government… illegal. 

This week, three pulbic forums will be held, and after those meetings, the plan's public review and comment period will end on Nov. 28, 2012. Information about the forums and other ways to comment on the proposed plan (without leaving your house) after the jump.
