Seems we are seeing a pattern here: MAGA wants to impeach President Joe Biden… for reasons? They can’t exactly say why, except that everyone knows they are trying to drown out the stench of their likely nominee for President having been impeached… twice.
Now the Maricopa County Republican Committee is pressing the Republican Caucus in the Arizona Legislature to impeach AZ Attorney General Kris Mayes… for reasons?
Their stated reason apears to be that AG Mayes had the temerity to get a Grand Jury of Arizona citizens agreeing with her prosecutors that probable cause existed that Supervisors Judd and Crosby down in Cochise County committed felonies under Arizona law in their attempt to subvert the 2022 elections under nakedly false claims of election fraud that have now been litigated into absurdity.
HOW DARE SHE HOLD CRIMINALS TO ACCOUNT! Doesn’t she know that GOP politicians are supposed to be above the law now?
This is their lie and disinformation-filled resolution. Let’s take a closer look, shall we?
MCRC Unanimously Passes Resolution Calling on the Arizona House of Representatives to Impeach Arizona Attorney General Kris Mayes
On Tuesday, December 5, 2023 the Maricopa County Republican Committee Executive Board and all Legislative District Chairs unanimously passed the below resolution:
WHEREAS, the Loyalty Oath of Office taken by all members of County Boards of Supervisors in Arizona requires them to swear to “support the Constitution of the United States and the Constitution and laws of the state of Arizona and defend the U.S. and Arizona against all enemies, foreign and domestic, and [to] faithfully and impartially discharge the duties of their office according to the best of [their] ability, so help me God.”
[Ed. Perhaps the first and foundational error by MCRP is that they seem to have forgotten that this part is in there: “… and the laws of the state of Arizona…” This part is the problem. This is the part Judd and Crosby are accused of violating, and which an Arizona Grand Jury found probable cause for.]
WHEREAS, We, the Executive Guidance Committee of the Maricopa County Republican Committee, condemn Arizona Attorney General Kris Mayes’ illegitimate political prosecution of the brave elected officials of Cochise County, Peggy Judd and Tom Crosby, for acting in accordance with their oath of office.
[Again, and as a former prosecutor I can’t repeat this part enough, it is NOT “Kris Mayes’ illegitimate political prosecution” it is the True Bill of an Arizona Grand Jury. All Mayes’ prosecutors did was present the evidence they had collected in their investigation, and any testimony the accused cared to give when they appeared before the Grand Jury. The citizens sitting on that Grand Jury decided that charges should be laid. Now it is up to the State to prove the charges TO AN ARIZONA JURY that Judd and Crosby did the deeds BEYOND A REASONABLE DOUBT, and to ARIZONA JUDGES that they have done so in conformity with the many legal protections afforded any criminal defendant. There is nothing ‘illegitimate’ or ‘political’ about this process: it is the normal justice process of which real conservatives have in the past been proud of (mostly), even while often lamenting just how difficult it can be to convict the guilty. Why don’t they trust the process and the courts to get this right if Judd and Crosby have been charged without sufficient evidence? What MCRC are now doing is calling into question the honesty and intregity of our Grand Jury process and the crminal process of our Courts. Could it be that they don’t REALLY care if Judd and Crosby actually did crimes, so long as they did them while on THEIR team trying to stymie a victory for Democratic candidates? Just who the hell does the MCRC think they are to ‘condemn’ our criminal process?]
WHEREAS, Article 7, Section 12 of the Arizona State Constitution states “There shall be enacted registration and other laws to secure the purity of elections and guard against abuses of the elective franchise.”
[I love it when non-lawyers throw irrelevant Constitutional language against the wall to make their nonsense seem profound… Are MCRC actually alleging that what the Cochise Board did was to prevent ineligible voters from voting? Nope. Completely irrelevant word salad that happens to contain the alluring phrase ‘guard against abuses’ to dangle before the slack-jawed army of MAGA cultists.]
WHEREAS, the Legislature passed Senate Resolution 1037 finding that computerized voting machines used in Arizona were not transparent and contained components manufactured, assembled, or tested in foreign nations like China and thus posed a threat to the security of elections
[The Republican-controlled Legislature on a party line vote making a ‘finding’ doesn’t make this vaguely racist and utter baseless nonsense a fact. It’s just official partisan nonsense and conspiracy delusions.]
WHEREAS, in passing Senate Resolution 1037, the Legislature further cited actual breaches of voting systems and uncured vulnerabilities making voting systems such as those used in Arizona subject to a material risk of manipulation.
[I can cite the mumbling nonsense of my hemroids whispering to me each night: doesn’t make it factual because I ‘cited’ said mumbling. This is again, just official partisan nonsense and conspiracy delusions being given the shine of authority. Much like a ball of turd sufficiently polished can be ‘cited’ as shinola…]
WHEREAS, A.R.S. 11-251.3 Powers of the Board, gives the Board of Supervisors the authority to “canvass election returns.”
[No. It doesn’t give them “authority”: it actually says they may “under such limitations and restrictions as are prescribed by law” canvas election returns. It gives them the ministerial ability and duty to do so subject to limits and restriction proscribed by our laws – which they flatly (and allegedly) violated. Therein lies the rub…]
WHEREAS, A.R.S. 16–622(A) states in relevant part: “The result printed by the vote tabulating equipment, to which have been added write-in and early votes, shall, when certified by the board of supervisors or other officer in charge, constitute the official canvass of each precinct or election district.”
[Note they did not emphasize “shall” here. This is not an enabling statute, it is just a requirement. “When certified by the board of supervisors” here means mere after they have done their ministerial and non-discretionary duty…]
WHEREAS, in enacting A.R.S. 16–622(A), the Legislature expressly left the decision as to “when” to certify any result obtained by the vote tabulating equipment to the discretion of the County Board of Supervisors.
[The legislature most certainly did not “expressly le[ave] the decision” to the Board as to when. There is a tight and statutorily defined timeline for canvassing. “When” just means after here, not “when” they fucking well please, and maybe not at all, if they don’t want to… The Board shall do it; Judd and Crosby listened to the legal giants who told them (much like the MCRC here) that the relevant bit was when and not shall, leading them to fuck around and find out.]
WHEREAS, widespread vote tabulating equipment malfunctions occurred in Maricopa County in the 2022 General Election.
[Wow. Not even a official turd polishing of this bald assertion of non-factual nonsense. More than a few Arizona Courts would wholly disagree with this assertion, and have the trial evidence to actually back that up.]
WHEREAS, critical tabulation errors also occurred in Pinal County in the 2022 General Election.
[Nope. Didn’t happen. Utter tosh and disinformation. They don’t even bother having the courtesy to try to polish a turd. Now let’s watch them libel some folks by implication…]
WHEREAS, at the Pinal County canvass meeting, Pinal Supervisor Jeff Serdy expressed concerns of a tabulation error that was rumored to have occurred. Election Director Virginia Ross did not acknowledge these concerns and County Attorney Volkmer stated “I can tell you that I am incredibly confident, as confident as I could possibly be, in the numbers that are being provided to this board”.
[An unspecified error that was “rumored to have occured”? This is certainly some low quality malarkey they are attempting to polish. And as a bonus MCRC clearly imply that the Election Director and County Attorney were in on the ‘cover up’ of the “rumored error”, whatever that might have been…]
WHEREAS, Public records later determined that the Pinal County canvass report was never balanced.
[What public records? What does the “canvass report was never balanced” even mean? I can’t even begin to guess, and I suspect MCRC can’t either. Sounds wonderfully definitive though, doesn’t it? Why didn’t they take these ‘determinative’ records to a court? Because they either don’t exist, or don’t determine squat; that’s why.]
WHEREAS, Pinal County Recorder Dana Lewis notified the AZSOS of the errors in an email prior to the State canvass and alerted them that they had“some discrepancies”.
[And? The Secretary of State was notified by an email of “some discrepancies”? So what? Mere inuendo and chaff aimed at the reputation of Governor Hobbs while she was Secretary of State.]
WHEREAS, issues like those that occurred in Maricopa County and Pinal County raise significant questions about the legitimacy of Kris Mayes’ election as Attorney General in the 2022 General Election, which are still being litigated in the Arizona courts.
[No. They don’t. There were court cases and recount that firmly say otherwise. #LyingAbe’s pending appeal is just another hopeless Hail Mary that will likely result in sanctions of the poor bastards with the poor judgment to have signed the filings. I’ll go with the trials and the counting of the actual ballots over MCRC’s ‘significant questions’, thanks.]
WHEREAS, Kris Mayes is using her prosecutorial powers as the Arizona Attorney General to interfere with the County Board of Supervisors’ responsibility and authority to ensure the Peoples’ right to a secure election, that is accurate and free from abuse or manipulation.
[‘Interfere’ with the Board’s ‘responsibility and authority’ to do a ministerial act? Their ‘right’ to try to hold up certification of the entire state’s elections? Or their ‘right’ to commit crimes under Arizona law? Sorry, such ‘rights’ are not right at all: according to Arizona’s laws, their acts were very wrong, indeed; they are simply felony level crimes.]
WHEREAS, Kris Mayes is abusing her prosecutorial powers as the Arizona Attorney General in bringing charges against Cochise County Supervisors Peggy Judd and Tom Crosby and is engaging in a transparent attempt to intimidate all County Supervisors from exercising their duties and authority to ensure the Peoples’ future elections are fair, accurate, and transparent in all aspects.
[If Mayes is ‘abusing’ her prosecutorial authority, or lapsing in her ethical obligations in any way, MCRP could file a complaint with the Arizona Bar. They haven’t, and won’t, because such an inquiry is a fact-finding process, whereas an impeachment is a purely political process. Such nonsense as this doesn’t even stand up to a casual reading, let alone of factual inquiry process. Such inconvenient things like ‘facts’ haven’t much bearing on what the MAGA GOP does when given a majority in a legislature endowed with that power. See the proposed impeachment of President Joe Biden.]
WHEREAS, Kris Mayes’ actions interfere with the independent powers of the Legislative branch which sets forth the responsibilities and authority of the County Board of Supervisors and thus violates the separation of power vested by the US and the Arizona State Constitutions.
[‘Mayes’ actions interfere with the independent power of the Legislative branch’ is utterly meaningless tosh, merely echoing the nonsensical ‘independent state legislature theory’ that has been driving MAGA attorneys around the bend recently. The claim of ‘violat[ing] the separation of power’ is perhaps the most insultingly silly assertion among a schmorgasboard of insulting nonsense. The Attorney General is specifically vested with the power to enforce Arizona’s laws, which is exactly what she is doing with Judd and Crosby.]
WHEREAS, Kris Mayes’ prosecution of Cochise County Supervisors Peggy Judd and Tom Crosby is an act of political prosecution common in dictatorships or communist countries.
[‘An act of political prosecution common in dictatorships…” Yep, that formerly Republican and notably conservative officeholder is definitely a secret dictator. And, anyhow, I thought that dictatorship was the new plan for second Trump term? He’s saying so himself. He admires distators like Kim, Putin, and Xi. Why are the MAGA GOP complaining about dictatorship when that’s clearly exactly what they are craving?]
THEREFORE, BE IT RESOLVED that We, the Executive Guidance Committee of the Maricopa County Republican Committee, call upon the Arizona House of Representatives to bring forward impeachment charges against Kris Mayes’ for her grotesque abuse of office, and violation of her oath to Constitution of the United States and the Constitution and laws of the state of Arizona.
[Wow. Smells like some mighty sententious wind blowing out of the rotting arseholes of the ‘Executive Guidance Committee’ up there in Maricopa. What I hear is the terrified whining of criminals complaining that their plot to steal the 2022 election has been undone at every turn and they are finally facing the frightening fact that their criminal conspiracies to mislead and defraud Arizona’s voters are now being unwound and prosecuted as the crimes they plainly were. We shall see whose version of these affairs are bourne out by our judicial processes, and which are proven to be merely a notably foul wind blowing out of the corpse of the dead and rotting party of a wannabe dictator.]

It should be amusing to see how much time the GOP Caucus wastes on this nonsense when the Lege comes back in session. It’s not like they have a self-inflicted half-billion-dollar hole in the budget to address or anything… If they do try to force some action against Mayes on this, it will be just another very good reason for voters to deprive the MAGA-crazed AZGOP of their majorities in the state House and Senate.
