Tucson City Council Election Update: Ron Asta Hearing Today at 1:30 p.m. (Updated)

According to the Minute Entry dated June 15, 2011 in Nicolle A. Callahan v. Ron Asta, et al., Case No. C20114352:

IT IS ORDERED that any responsive pleading, including any answer, will be filed in this matter by no later than midnight on June 16, 2011. Copies of the responsive pleading or answer can be provided to the parties by email, with the original to be filed with the Clerk.

IT IS FURTHER ORDERED setting a Trial re Motion for Preliminary Injunction on June 17, 2011 at 1:30 p.m. in Division 28; for two (2) hours.

The parties are further directed to make arrangements with the Courtroom Clerk Supervisor at (520) 740-8279, by 11:00 a.m. on Friday, June 17, 2011, to have all exhibits pre-marked prior to the hearing.

Plaintiffs exhibits will be marked numerically and the defendants exhibits will be marked alphabetically as follows: the Elections Division exhibits will be marked as A; the City will be B; and the candidate will be marked as C.

Mr. McLaughlin makes statements to the Court regarding the City position in this matter.

IT IS FURTHER ORDERED that Mr. McLaughlin and Mr. Randolph shall appear at the hearing set on June 17, 2011 in Division 28.

Division 28 is Judge Paul Tang, Courtroom 472.

Ron Asta has been struck from the Republican Primary ballot after a challenge from the family of Jennifer Reeves, the high school senior who was killed in a car accident caused by Asta in 1994.

Asta did not contest the evidence against the signatures he filed, subsequently the court ruled that he could not be a candidate.

Got that? Ron Asta did not contest that he did not have enough valid signatures to qualify for the ballot.

There was an agreement between Republicans Ron Asta and Shaun McClusky not to contest one anothers petitions because both candidates knew or had reason to know in the exercise of due diligence that they did not have enough valid signatures to qualify for the ballot.

In other words, they were willing to perpetrate a fraud upon the voters for a chance to appear on the ballot with the full knowledge that they did not have enough valid sigantures to qualify for the ballot, as required by law.

Jennifer Reeves' cousin Nicolle Callahan is to be applauded for taking it upon herself as a pro per plaintiff to challenge the petitions of Ron Asta. The Pima County Democratic Party has contested the petitions of Shaun McClusky who also does not have enough valid signtures to qualify for the ballot, as the evidence will show.

A fraud has been averted, and justice has been served.

UPDATE: Quote of the day:

Nicolle Anne Callahan was flabbergasted that Asta asked to stay on the ballot even though he acknowledged he didn't have the signatures. "He seems to think the rules don't apply to him."

  1. Ron Asta did not contest that he did not have enough valid signatures to qualify for the ballot, as required by law. It’s called the rule of law, that was her grounds.

  2. On what grounds? Seems like “personal vendetta” and “I hate this guy” which are valid in a way but NOT in public office.
