Official List of Federal Candidates Filed To Run For The August Primary 2022

Monday, April 4 was the filing deadline for candidates to file to run for office in the August 2, 2022 Primary Election. The Arizona Secretary of State now has an official list of the federal candidates who filed to run by the deadline.

Independent candidates do not have a primary and are not listed. There could also be some late write-in candidates who may qualify.

All four of Arizona’s current Republican members of Congress were among the 147 Republican lawmakers who still objected to the election results even after the Capitol attack, and thus provided aid and comfort to the violent insurrectionists in violation of 18 U.S. Code § 2383:

Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.

In addition, they are disqualified from holding office under Section 3 of the 14th Amendment:

Section 3

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Lawyers should file legal challenges to their qualifications now. A.R.S.§ 16-351 (excerpt):

A. Any elector filing any court action challenging the nomination of a candidate as provided for in this chapter shall do so not later than 5:00 p.m. of the tenth day, excluding Saturday, Sunday and other legal holidays, after the last day for filing nomination papers and petitions. The elector shall specify in the action the petition number, line number and basis for the challenge for each signature being challenged. Failure to specify this information shall result in the dismissal of the court action. Within ten days after the filing of the action, the superior court shall hear and render a decision on the matter. The decision is appealable only to the supreme court, and notice of appeal shall be filed within five days after the decision of the superior court in the action. The supreme court shall hear and render a decision on the appeal promptly.

B. Any elector may challenge a candidate for any reason relating to qualifications for the office sought as prescribed by law, including age, residency, professional requirements or failure to fully pay fines, penalties or judgments as prescribed in sections 16-311, 16-312 and 16-341, if applicable.

In addition, Reps. Andy Biggs and Paul Gosar have been implicated in the planning of the January 6, 2021 insurrection. Arizona Reps. The January 6 Committee very well could make criminal referrals to the Department of Justice before the August primary.

Arizona voters should save the taxpayers the undue delay and expense of prosecution, and remove Reps. Biggs, Gosar, Lesko and Schweikert from office.
