Prop 122 & Backers Ducey & Brnovich Are Too Extreme for Arizona

Prop 122 would allow any Arizonan, the Arizona Legislature, or local law enforcement (like Sheriff Joe Arpaio) to determine the Constitutionality of federal laws.

Brought to you by the Goldwater Institute and the Koch Brothers, Proposition 122 is the worst idea since the Civil War, and true to form with other Koch Brothers initiatives, it is being sold to us with lies and dark money.

Prop 122 would amend the Arizona Constitution to: 1) confirm that both the state and federal governments must follow the US Constitution; 2) give “Arizona” the right to determine what is Constitutional (instead of the Supreme Court); and 3) give the state government authority to stop all levels of government (state, county, city, town or other political entity) from using personnel or finances to “enforce, administer or cooperate with a federal action or program if the people or their representatives have exercised their authority to restrict such action or use,” quoting Arizona’s Election Guide from the Secretary of State’s office.

In other words, if “the people or their representatives” decide that a federal law is unconstitutional, the state can stop, all levels of government in Arizona from cooperating with the federal government on that law.

I have to say there have been some encouraging developments in the AZ midterms the past few days. First Howie Fischer weighed in, and then the Arizona Republic (finally) ran a piece highlighting the significant differences on so-called “social issues”, that is, a host of things that affect a lot of people’s lives, rights, financial situation, ability to participate fully in society, etc., but do not necessarily fall within the confines of what rich white people consider important.

While Arizona’s most controversial social policies have generally originated in the state Legislature and the courts have had the final say, the governor is the gatekeeper. As the state’s chief executive, the governor holds the veto stamp and has historically used it to push back on legislation deemed too far outside the public interest.

Doug Ducey loves Texas so much he wants to replicate it for poor women in Arizona

Doug Ducey likes to praise Texas, often. He wants their state tax income rate (none) and their health care policies (no ACA exchanges, no Medicaid expansion). Ducey most assuredly wants the reproductive rights climate that currently exists in Texas, where the Fifth Circuit Court upheld spurious TRAP laws passed last year (and famously filibustered by State Senator Wendy Davis) which will close all but seven clinics in the entire state. Rural areas, including all of West Texas, will be without a single abortion provider.

Yet another televised debate ignores reproductive rights.

This is getting old. Monday night’s Clean Election debate was aired on Phoenix PBS Channel 8 and, of course, there was not one question on the candidates’ stances on reproductive rights. It’s as if the entire MSM here has developed amnesia about the legislature here and their constant attempts to restrict and deny access to common forms of women’s health care like abortions and contraception. Whoever is governor is going to be getting a buttload of bills concerning the proper use of the female chattel and their ladyparts. It matters who that Governor is and the candidates ought to be asked to provide detailed answers on their positions. I mean, dear lord, couldn’t these media people at least consider how much of their precious, holy tax money is going to go to defending these things in court? I guess not.
