TOMORROW: Senate Judiciary Committee To Question Mike Liburdi For Judgeship; Trump Nomination Bypassed Arizona Senators

Mike Liburdi will have his hearing in front of the Senate Judiciary Committee tomorrow morning. Liburdi was nominated last month by Presdient Donald Trump to fill one of the two judicial vacancies on Arizona’s U.S. District Court bench.

Liburdi was Governor Doug Ducey’s General Counsel between 2015-2018. He applied for the lifetime appointment in August of last year by going directly to the Department of Justice. In 2016-17, he had not been considered by a judicial selection committee that had been set up by Arizona’s two Senators.

Typically, the Senators recommend individuals to the Administration for such nominations in their home states – particularly when the Senators and the President are of the same party. For example, the other pending judicial nomination from Arizona was vetted and recommended by McCain and Flake in early 2017.

Hon. Bridget Bade’s nomination for a position on the 9th Circuit Court of Appeals was approved by the Senate Judiciary Committee last week on a remarkably bipartisan vote of 17-5. Her nomination is now ready to be voted on by the entire Senate.

The differing pathways for the Bade and Liburdi nominations was set forth in their written submissions to the Committee, and lays bare some of the tension that existed between Trump, McCain and Flake.

Sen. Jeff Flake threatens to hold up judicial nominees over protection for Mueller (Updated)

The always desperate for media attention Arizona Senator Jeff Flake Flake says he’ll oppose judicial nominees until Mueller bill gets vote:

Sen. Jeff Flake (R-Ariz.) said on Wednesday that he will oppose any of President Trump’s judicial nominations until legislation protecting special counsel Robert Mueller gets a vote.

“I have informed the majority leader I will not vote to advance any of the 21 judicial nominees pending in the Judiciary Committee or vote to confirm the 32 judges awaiting confirmation on the Senate floor until … [the bill] is brought to the full Senate for a vote,” Flake said from the Senate floor.

Flake’s threat will block the Judiciary Committee from approving judicial nominations and sending them to the full Senate without help from Democrats. Republicans hold a 11-10 majority on the panel and many of the most controversial nominees pass along party lines, meaning they would need either Flake’s vote or a Democratic senator to flip.

On the Senate floor, Majority Leader Mitch McConnell (R-Ky.) has slightly more leeway. With a 51-49 majority, Flake would need a Republican colleague to join him and every Democrat to block a judicial nominee on the Senate floor.

His decision comes after McConnell blocked Flake from bringing legislation to protect Mueller from being fired to a vote before the Senate.

I texted thousands of Arizonans, wrote articles, and helped tell her story to Arizona veterans. As a Tucson native, combat veteran and the spouse of an active duty military member – I wanted the voice of vets like me to be heard. I wanted to help Sinema win this seat and make sure that Martha McSally and her Trumpist rhetoric lost not only her Congressional seat in Tucson, but this coveted Arizona Senate seat as well.

(Update) A sham hearing and a denial of due process

This is unprecedented for a confirmation hearing.

The eleven privileged white male Republicans on the Senate Judiciary Committee are going to hide behind the skirts of a hired gun female prosecutor to question Christine Blasey Ford and Judge Brett Kavanaugh because they cannot contain their obvious contempt for a woman who is the victim of a sexual assault and express their view that the real victim here is privileged white male Brett Kavanaugh.

Senator Bob Corker (R-TN) concedes that GOP men can’t be trusted to treat Dr. Ford appropriately during hearing:

Sen. Bob Corker (R-TN) is praising the move by GOP Judiciary Committee members to use outside counsel to question the accuser of Supreme Court nominee Brett Kavanaugh during Thursday’s hearing. It’s pure genius, he said, because, frankly, GOP men simply can’t be trusted to act culturally appropriate toward a woman.

“I think it’s really smart of them to get outside counsel,” Corker told reporters on Capitol Hill Tuesday. When asked why he thought the all-male Republican members of the panel shouldn’t handle the questioning of Dr. Christine Blasey Ford themselves, Corker responded:

“Somebody will do something that you guys will run 24/7 and inadvertently somebody will do something that’s insensitive.”

Gee, “insensitive” like calling Dr. Blasey Ford “mixed up” such as Sen. Orrin Hatch (R-UT) did or saying her sexual assault claims have been a “drive-by shooting” of Kavanaugh like Sen. Lindsey Graham (R-SC) did? Both are members of the Judiciary Committee but, really, how could any man be expected to know that dismissing a PhD and trauma victim as “this woman” or “that lady” is sexist? C’mon, give the fellas a break—people are so touchy touchy these days about basic human decency.

“Gee, what could possibly be more sexist than hiring a woman to do the dirty work while the men ultimately continue to retain all the power?”
