MSNBC’s Ari Melber on Tuesday said that he had acquired a “damning” new recording of Sen. “traitor” Ted Cruz (R-TX) discussing how to potentially overturn the results of the 2020 presidential election.
“I think that the country deserves to have a credible assessment of these claims and what the evidence shows and the mechanism to try to force that is denying certification on the sixth,” Cruz told Fox host [and Trump Fluffer] Maria Bartiromo on Jan. 2, 2021.
“‘Forcing this reassessment,’ as he so dryly put it, of [Joe] Biden’s actual win,” alleged Melber, “was for Cruz one step in a larger coup plot. And that’s what the next tape I’m going play for you shows after the violence on Jan. 6th, there was, of course, the ongoing process of trying to overthrow the election Cruz early in that day right before the Capitol was breached was one of 11 senators denying. I should point out, the majority of senators didn’t go that far. That’s just one thing. Then there’s step two, which you can hear yourself tonight.”
“Who’s deciding who gets inaugurated?” Bartiromo asked.
“It would be the results of the commission and what they find, and if they found credible evidence of fraud that undermines confidence in the electoral results in any given state they would report on that,” Cruz told her.
Melber explained that this is a tape of Cruz thinking that he was talking in secret.
“He admits it,” Melber continues. “You heard the question — who decides who gets inaugurated that’s what this is all about. You have a certified winner. You have the courts having passed up any potential challenge. So, at that point, it was President-elect Biden, and Cruz answers this fake, made-up commission he and his Trump buddy were planning to create to bureaucratize a coup. That’s what they were trying to do. That was his answer. That’s how they were trying to steal the race. The references to fraud, we know, one, he didn’t believe in those we have that on tape. B. more importantly, the judges and fact-finding we have in the country didn’t find there was that kind of fraud and then 3. that’s all just talk anyway because they’re literally trying to steal it for Trump, so all the words in the middle are just the words to get there.”

The Texas Senator backed Supreme Court challenges to election results, and in his own state, supported an effort from Attorney General Ken Paxton to have results overturned in four other states. On Jan. 6, Cruz voted against the certification of votes from Arizona and Pennsylvania, and continued to spread claims of fraud long after Biden was sworn into office.
Behind the scenes, however, Cruz was cautioning Trump allies that they would need “specific evidence” of fraud if they wanted to prevail in court. In a new recording obtained Thursday by MSNBC’s Ari Melber, Cruz tells Fox Host Maria Bartiromo that they would need “actual facts” if their legal challenges to the election were to be taken seriously.

“It can’t just be, you know ‘somebody tweeted this,’” Cruz says, “It’s got to be demonstrable facts that can be laid out with evidence because that’s what a court of law is gonna look to — not just an allegation but actual facts.”
Cruz went on to say that he was hopeful that “when Rudy [Giuliani] comes on the show tomorrow, he had some of those facts, and I hope the legal team continues to lay out the specific evidence, because that’s what it’s gonna take to prevail in court.”
On Tuesday Fox News settled a historic defamation lawsuit brought against them by Dominion Voting Systems for $787.5 million. Dominion had accused the network of airing false statements claiming the company had a role in orchestrating election fraud on behalf of President Joe Biden.
The recording of Cruz’s conversation with Bartiromo was created by a former Fox News producer who is suing the network. Abby Grossberg, who worked as a producer for Bartiromo and Tucker Carlson, alleges that the network coerced her into changing her testimony in a deposition given to Dominion. Previous tapes made public by Grossberg included audio of a Trump campaign official admitting “there weren’t any physical issues with [Dominion] machines on those inspections.”
But Fox’s role in spreading Trump’s baseless claims of election interference was just a small fraction of a widespread effort by the former president’s allies to subvert democracy and secure a second term for Trump. Of the 62 lawsuits that challenged the results of the election, 61 failed in court.

Special Counsel Jack Smith has expressed interest in audio tapes recorded by former Fox News producer Abby Grossberg while she worked at the right-wing network, her lawyer said.
Grossberg attorney Gerry Filippatos told CNN on Wednesday that he has given a spreadsheet to the special counsel’s team, detailing the nearly 90 audiotapes in Grossberg’s possession. Talks are underway for a subpoena, so Grossberg can turn over the material to Smith’s team of federal prosecutors, who are investigating efforts by former President Donald Trump and his allies to overturn the 2020 election.
“We’re in the process of negotiating a targeted subpoena for Abby’s electronic data, so they can have what they want,” Filippatos said.
Federal investigators initially reached out several weeks ago, after some of the tapes were aired by news outlets, Filippatos said. He added that Grossberg is committed to cooperating fully with law enforcement – which could include an eventual FBI interview or meetings with other investigators.
“They reached out to us after we publicized some of the tapes,” Filippatos said, referring to recordings of Fox host Maria Bartiromo discussing 2020 election conspiracy theories with Trump lawyers Rudy Giuliani and Sidney Powell, where they were “being candid off-air and saying something contrary to what they said on-air.”
