In a new formal opinion, [AZ Attorney General] Brnovich acknowledged there are laws prohibiting the use of public funds to influence the outcome of elections — a restriction he noted that applies even before a proposal has qualified for the ballot.
But Brnovich said no law prohibits public education campaigns — even ones that are not fair and balanced. He said even one-sided arguments are permitted “so long as they do not unambiguously urge the electorate to cast a vote for or against the measure.”
The opinion is a significant victory for Yavapai County Attorney Sheila Polk.
It’s possible that this isn’t an approving retweet by Cathi Herrod but, given her ardent support of Mark Brnovich in the election and her just being an all-around terrible person, I’d say it’s a safe bet that it is.
Arizona Attorney General Mark Brnovich decided to lash out at Republic columnist Laurie Roberts by euphemistically calling her a liar (“misleading”). Roberts merely directly quoted what was in the motion to dismiss filed by his office against a lawsuit filed by a rape victim alleging shocking negligence by the state prison. Here are some exact words from the motion:
The Arizona Attorney General’s Office is asking for dismissal of a lawsuit filed by a teacher who was brutally assaulted and raped after being left in an unguarded prison classroom with a convicted sex offender.
The AG’s reasoning is essentially this: the woman knew she was in a prison, so what did she expect?
Unfortunately, Roberts didn’t come up with an answer.
It’s not really a legitimate rhetorical question if the audience/readers cannot answer it for themselves. There is, however, a clear answer available. Voters — especially Republicans whose interests are being subverted — need to become aware of the background, reasons and the stakes involved.
Prop 122 would allow any Arizonan, the Arizona Legislature, or local law enforcement (like Sheriff Joe Arpaio) to determine the Constitutionality of federal laws.

Prop 122 would amend the Arizona Constitution to: 1) confirm that both the state and federal governments must follow the US Constitution; 2) give “Arizona” the right to determine what is Constitutional (instead of the Supreme Court); and 3) give the state government authority to stop all levels of government (state, county, city, town or other political entity) from using personnel or finances to “enforce, administer or cooperate with a federal action or program if the people or their representatives have exercised their authority to restrict such action or use,” quoting Arizona’s Election Guide from the Secretary of State’s office.
In other words, if “the people or their representatives” decide that a federal law is unconstitutional, the state can stop, all levels of government in Arizona from cooperating with the federal government on that law.
